The ruling dealt a blow to an industry that has largely avoided serious accountability at the federal level.<\/p>\n<p>Read more <a href=\"https:\/\/urbaneconomynews.com\/?p=1461\">The Cultural Revolution Is in Full Swing<\/a><\/p>\n<p>A Ninth Circuit panel rejected appeals from Meta and TikTok, finding the companies\u2019 bid to escape liability came too early in the litigation. The tech giants had argued Section 230 of the Communications Decency Act, the decades-old law that shields online platforms from liability for content posted by third parties, entitled them to immunity from the lawsuits altogether.<\/p>\n<p>The court disagreed. In a 24-page opinion, Judge Jacqueline Nguyen wrote that Section 230 provides companies a defense against liability, not a blanket shield from being sued in the first place, a distinction that clears the path for the cases to proceed toward trial.<\/p>\n<p>The ruling is a significant setback for Silicon Valley companies that have long leaned on Section 230 to fend off litigation over the real-world consequences of their platforms. Thousands of plaintiffs accuse Meta of engineering its products to be habit-forming for young people, including by making parental controls easy to circumvent and allowing minors to stumble onto exploitative content.<\/p>\n<p>Read more <a href=\"https:\/\/urbaneconomynews.com\/?p=1459\">The Delusional Premises of Woke Greens<\/a><\/p>\n<p>The litigation follows a March verdict in which a jury found Meta and YouTube negligent and liable for harming users on their platforms. Jurors awarded $3 million to a young woman who testified that her social media addiction fueled depression, anxiety and body dysmorphia, and recommended an additional $3 million in punitive damages. TikTok and Snap Inc., the maker of Snapchat, settled with the same plaintiff before that trial began rather than face a jury.<\/p>\n<p>The Ninth Circuit also denied a separate request from Meta on Monday to postpone a trial over allegations the company exploited data harvested from children to keep them engaged on its platforms.
