A United Nations committee is calling on countries, including the United States and United Kingdom, to provide reparations to people of African descent for the continuing effects of the transatlantic slave trade, potentially including financial compensation.<\/p>\n

The U.N. Committee on the Elimination of Racial Discrimination issued guidance Monday arguing that countries have present-day obligations under the legally binding 1965 International Convention on the Elimination of All Forms of Racial Discrimination.<\/p>\n

\u201cStates Parties must implement comprehensive reparatory measures for people of African descent, covering all aspects of remedies,\u201d the committee said.<\/p>\n

The guidance applies to the 182 countries that are parties to the convention, including the United States, United Kingdom, France and Portugal.<\/p>\n

The committee\u2019s position represents what it describes as a \u201cparadigm shift\u201d in the reparations debate. Rather than determining whether slavery violated international law when it occurred, the committee argues that governments have a current obligation to address racial inequalities it attributes to slavery and colonialism.<\/p>\n

\u201cIrrespective of the legal characterization of the original historical acts, States Parties remain bound by their present obligations under the Convention to address structural inequalities,\u201d the document states.<\/p>\n

That approach attempts to sidestep a longstanding argument against reparations known as the intertemporality principle, under which historical conduct is generally judged according to the law that existed at the time.<\/p>\n

The committee says financial compensation should be among the remedies considered but argues that money alone is insufficient. It also recommends measures including opening historical archives, changing public memorials and establishing independent truth commissions.<\/p>\n

U.N. estimates indicate approximately 12.5 million Africans were forcibly transported and sold during the transatlantic slave trade between the 15th and 19th centuries.<\/p>\n

Reparations remain politically contentious. Critics argue that governments and taxpayers today should not be financially responsible for actions committed generations ago, while advocates contend that the economic and social consequences of slavery continue to affect descendants.<\/p>\n

The European Union and Britain abstained from a U.N. resolution concerning slavery in March.<\/p>\n

Pela Boker-Wilson, a Liberian lawyer who helped draft the new guidance, said governments should move beyond symbolic expressions of regret.<\/p>\n

\u201cWe are calling on state parties to take concrete and meaningful action,\u201d she said.<\/p>\n

The committee\u2019s guidance could be cited in future litigation, but it does not itself constitute a court order directing the United States or other countries to immediately make cash payments.<\/p>\n
