House Judiciary Committee Republicans accusing the Biden administration’s Justice Department and former special counsel Jack Smith’s team of violating constitutional protections while obtaining records connected to Republican members of Congress.

The 57-page report alleges prosecutors obtained phone records involving lawmakers as part of the Arctic Frost investigation into President Donald Trump and efforts surrounding the 2020 election. The committee characterized the actions as an infringement on the separation of powers and Congress’ constitutional protections.
“The Biden-Harris Administration, including Special Counsel Smith, ran roughshod over key constitutional protections to spy on Republican Members of the U.S. House of Representatives and Senate,” the Republican-led committee concluded.
The committee’s investigation has focused partly on the Speech or Debate Clause, which protects lawmakers from being questioned elsewhere over legislative acts.

The report follows months of disclosures about Arctic Frost. Judiciary Republicans said Tuesday that investigators subpoenaed phone records belonging to more than a dozen Republican lawmakers and obtained orders preventing lawmakers from learning about the subpoenas. The committee also released testimony from five former Smith prosecutors and former Justice Department inspector general agent Brian Burnett.
Earlier disclosures showed Smith’s investigation obtained toll records, which generally reveal information such as when calls occurred and who participated, rather than their content. Separate records released this year showed investigators obtained text messages involving Trump administration officials and 44 members of Congress.
Smith investigated Trump over classified documents and alleged efforts to overturn the 2020 election. The resulting federal cases were later dismissed after Trump won the 2024 election.
