A federal judge Wednesday blocked President Donald Trump’s latest attempt to restrict birthright citizenship, ruling that the administration’s new policy is likely unconstitutional.

U.S. District Judge Deborah Boardman, a Biden appointee, issued a preliminary injunction preventing enforcement of Trump’s latest executive order against a class represented by two immigration advocacy groups.
The order seeks to deny automatic citizenship to additional categories of children born in the United States, including children of “alien enemies of the United States,” members of foreign terrorist organizations and certain people who lobby or act on behalf of foreign governments.
Boardman concluded in that the new directive was “almost certainly unconstitutional as applied to the certified class.”
“This Court must, once again, preliminarily enjoin enforcement of the President’s most recent attempt to strip the right to citizenship from them,” Boardman wrote.
The ruling marks another setback for Trump’s effort to narrow the government’s interpretation of the 14th Amendment’s Citizenship Clause.

The Supreme Court previously ruled against the administration’s initial attempt to restrict birthright citizenship. Trump’s latest order sought to address additional categories of foreign nationals while continuing the administration’s challenge to the longstanding interpretation that nearly everyone born on U.S. soil automatically becomes an American citizen.
The administration’s immigration efforts have also targeted so-called birth tourism.
Trump signed a separate executive order last month directing the State Department to develop additional rules and guidance aimed at preventing foreigners from traveling to the United States for the purpose of giving birth and obtaining U.S. citizenship for their children.
Federal visa rules already prohibit issuing certain tourist visas when officials determine that an applicant’s primary purpose for traveling to the United States is giving birth so the child obtains citizenship.
