Two minutes of hate:

On Sunday, a three-judge panel of the Ninth U.S. Circuit Court of Appeals held an emergency hearing on the Trump administration’s request to require California election officials to segregate approximately 20,000 mail ballots associated with registered voters the Justice Department suspects are noncitizens. According to Fox News, during the nearly two-hour hearing the judges questioned the federal government’s legal arguments and whether the appellate court has jurisdiction to intervene before the district court rules. Judge Mark Bennett, a Trump appointee, questioned whether the requested injunction would conflict with the Constitution’s Elections Clause and California’s established election procedures. Judge Gabriel Sanchez, a Biden appointee, questioned the timing of the appeal, while Judge Patrick Bumatay, another Trump appointee, focused more heavily on the government’s concerns about potentially ineligible voters.

The DOJ filed suit against California on October 16, demanding citizenship verification of 20,000 ballots within 48 hours. Los Angeles election officials responded to the suit with a damaging admission: they have no way to verify citizen status at all.

Requiring voters to prove they are eligible to vote is very popular with Americans. When half the country is experiencing a mass political and cultural psychosis, it’s unusual to find an issue with so much support.

(fielded September 26–28, 2026, published October 5) found:

  • 82 percent support requiring a valid photo ID to vote (95 percent Republicans, 73 percent Democrats, 78 percent independents)
  • 79 percent support requiring proof of citizenship to vote
  • 72 percent support “tightening voter ID requirements for the 2026 Congressional midterm elections.”

The House and the Senate could pass a law requiring proof of citizenship to vote with almost no electoral consequences, according to the latest poll. I should add that the polling is very consistent on this, Harvard-Harris is not an outlier. But they don’t. You have to wonder, cui bono?

The panel indicated that it would attempt to issue a ruling quickly. I am not optimistic.

Speaking about elections, here is something that appears very suspicious. Brazilian President Luiz Inácio Lula da Silva won an unprecedented fourth presidential term Sunday, defeating conservative Sen. Flávio Bolsonaro in a closely contested runoff election. With all votes counted, Brazil’s electoral court reported that Lula received approximately 51.8 percent of the vote, compared with Bolsonaro’s 48.2 percent, a margin of nearly 4.4 million votes.

Curiously,  Bolsonaro beat Lula in the initial election with 47.12 percent to Lula’s 45 percent. The election requires the president reach a 50 percent threshold so the top two candidates moved to a run off. At the last minute, there was an unusual intervention by Supreme Court Justice Cristiano Zanin, who ordered voting extended by two hours after complaints about transportation problems prevented some voters from reaching polling stations. Sound familiar?

Bolsonaro, the son of former President Jair Bolsonaro and an ally of President Donald Trump, refused to concede and called for the results to be annulled.
